Duration and distribution of part-time contract hours

Without prejudice to the agreement, the employer may, at any time, offer the maid the completion of complementary hours of voluntary acceptance. In this case, it may not exceed 15%, expandable to 30% by collective agreement. Of course, the maid can refuse without implying punishable work behavior.

The pact of complementary hours may be without effect by the resignation of the maid. To do this, you will have to give a 15-day notice, once one year has elapsed since its celebration. Besides, you will have to allege any of the following reasons: attention to family responsibilities for legal guardianship, training needs – provided that your schedule makes it impossible to perform them – or incompatibility with another part-time contract.

Concerning the remuneration of the complementary hours, they have to be paid the same as the ordinary ones. They are also computed for the Social Security contribution bases.

Formalization of the part-time contract

In the official model established for this type of contract, the number of ordinary hours of work per day, week, month or year contracted and its distribution must be included. Another important point is that part-time maids who are not receiving economic benefits for unemployment may voluntarily sign a special Social Security Agreement. With this, you can supplement your Social Security contribution (paid by the maid), to have a greater pension in the future.

In the case of a partial retiree, you can reduce your workday, and thus turn it into a part-time contract. This reduction can be between 25% and 75% provided that the relief contract is concluded full-time and indefinitely, or between 25% and 50% if it is another type of contract.
