UK Family Visa

Looking to stay in the UK with your family? The family visa category is perfect for you. You can travel to the United Kingdom to visit family relatives or spouses who live there. The process, however, is dependent on the nature of the relationship, their residency status, and the length of time you intend to stay.

Eligibility for a Family Visa

A UK Family Visa is required if you are planning to settle your family in the UK. You can apply for a number of visas according to your conditions. A UK Visa is only eligible for families living for more than six months in the UK. You will require a family visa in case you are outside the UK and are planning to join your UK resident family members

You can apply for a UK family visa in any part of the world. A foreign travel permit or legal document from the European Union is required if you intend to live in that country. They must include documents relating to your current and existing visas. A Home Office visa is only required if you live in the UK and can be obtained by working abroad.

Financial Requirements:

This article explores the criteria for a sponsor who wants to bring family members to the UK to join or stay with them but is reliant on revenue from specific rights or benefits.  The following are the specific financial requirements – or financial income criteria – that a sponsor must meet in order to sponsor family members under the application:

  1. If you and your partner have a combined annual income of at least £18,600, you must submit a combined income application. These applications are a bit more complex than regular applications, which is why it is important to do your research beforehand.
  • For sponsoring children, you need to be currently earning an additional £3800 for your first child and £2400 for every child after that.

The eligibility requirements for children include:

  • They are neither British nor Irish nationals
  • Lack of established status
  • Are not permanently settled in the United Kingdom

You may not need to show you have additional money if your children are EU, Iceland, Liechtenstein, Norway, or Switzerland citizens who do not have post-residency or are not permanently established in the UK. It is better to consult your case with an experienced immigration attorney since each case is unique.

3.    The following documentation will be required:

  • Earnings before tax and national insurance (Pay Slips) – you will only use your personal income if they were earned in the UK.
  • Check your self-assessment tax return for income you generate as a sole trader or as a director of a limited business in the UK.
  • Over £16,000 in cash savings
  • Any pension money received
  • Passive income, such as rental income or dividends

If you’re utilizing self-employment or employment income, you’ll need to show that you or your partner received it for at least six months.

Necessary Documentation

Proof of income is extremely important for your family visa application.

  • Bank statements that reveal your income or that of your partner
  • 6 months’ worth of pay stubs.
  • A letter from an employer, dated and printed on company letterhead. The letter from the employer should state that there is a job for you or your partner there.
  • The current position at the company and the time you’ve worked there
  • The contract’s nature (for example, permanent, fixed-term)
  • How much you or your partner earn before taxes and NI
  • How long has your present wage been paid to you or your partner?
  • Proof that the pay stubs are authentic.

There are also several instances of complicated applications where the income cannot be portrayed correctly. For example if a paternity or maternity leave was taken during the previous 6 months or if you’re looking to combine different income streams.

If you decide to reach out to experienced lawyers, they can also help describe what proof you must give for each form of income you rely on.

Minimum Income Criteria

If you wish to settle in 5 years as a couple, you must establish that you and your partner fulfil the minimum income criteria.
